5. Scope
These Terms and Conditions apply to all visitors of this website and to all orders placed through kunanets.art. By using this website and/or placing an order, you agree to these Terms and Conditions.

The button that completes your order is labelled “Order and pay”. By clicking it you submit a binding offer to buy the item shown at the price shown, and you accept the obligation to pay. Payment is taken immediately in the same step.
6. Products
Kunanets.art offers original artworks and other physical art-related products created or offered by Khrystyna Kunanets. Because artworks are handmade and individually finished, slight variations in color, texture, dimensions, and details may occur. Such minor variations do not constitute a defect.
7. Product Presentation
We make every effort to display artworks and products as accurately as possible. However, actual colors and details may vary depending on screen settings, lighting, photography, and device display.
8. Prices and Taxes
All prices on this website are shown in US dollars (USD). Unless expressly stated otherwise, prices do not include customs duties, import taxes, local VAT, or similar charges that may apply in the destination country. Such charges are the responsibility of the customer.
Shipping is free worldwide, so no delivery charge is added at checkout. Any import duty, import VAT, GST or customs handling fee charged in your country is not included in the price and is paid by you on delivery; see Shipping & Customs.
9. Orders and Contract Conclusion
The presentation of products on this website does not constitute a legally binding offer, but an invitation to place an order. By submitting an order, the customer makes a binding offer to purchase the selected product or products.
The contract is concluded only when the seller accepts the order by sending an order confirmation by email, dispatch confirmation, invoice, or by shipping the goods. We reserve the right to refuse or cancel orders in justified cases, including product unavailability, pricing errors, suspected fraud, or incomplete customer information.
10. Payment Processing
Payments on this website are processed by Monobank (Universal Bank JSC, Ukraine) through its Plata by mono service and its authorised payment partners. You are handed over to Monobank’s own secure payment page to enter your card details. We never see and never store your card number, expiry date or security code.
Prices are displayed in US dollars. Because the payment is collected in Ukraine, your card is charged in Ukrainian hryvnia (UAH), converted at the exchange rate applied by your card network and your bank at the moment of the transaction. Your bank may add a currency conversion or foreign transaction fee, and the amount that appears on your statement in your own currency may therefore differ slightly from the US dollar price shown here. 11. Shipping and Delivery
Orders are shipped worldwide from Ivano-Frankove, Lvivska oblast, Ukraine, with Ukrposhta, free of delivery charge, tracked and insured. Orders are dispatched within 1–3 business days. Estimated transit times by destination, packing, tracking, lost or damaged parcels and the procedure if an order is delayed are set out on the Shipping & Customs page, which forms part of these Terms.
Delivery times stated there are estimates, not guaranteed dates, and may vary with the destination, customs processing, carrier delays and circumstances beyond our reasonable control. Unless a longer period is agreed with you, we dispatch within 30 days of the conclusion of the contract; if we cannot, we will contact you, offer you a revised date, and you may cancel and be refunded in full.
The customer is responsible for providing a correct and complete delivery address. If a parcel is returned to us because the address was wrong, because delivery was refused, or because it was not collected within the carrier’s holding period, the return carriage and any customs or storage charges incurred are borne by the customer and may be deducted from a refund; a second shipment is charged at cost and quoted in advance.
12. Import Duties and Customs
We ship on DAP terms (Delivered at Place): we pay carriage to your address, and any import duty, import VAT, GST, sales tax, customs brokerage or handling fee charged in the destination country is the responsibility of the buyer and is collected from the buyer on delivery. Every customs declaration states the true sale value, the description “Original hand-painted oil painting by the artist”, the country of origin, and HS code 9701.91. We do not understate the declared value and we do not declare sold goods as a gift.
Original hand-painted artworks under this classification are currently free of customs duty in the United States, the United Kingdom and the European Union, but duty-free does not mean tax-free: import taxes and carrier handling fees may still apply. 13. Right of Withdrawal and Returns
Consumers may withdraw from the purchase within 14 calendar days from the day the goods are received, unless an exception permitted by applicable law applies. Paintings made to the customer’s specification — commissions, custom subjects and custom sizes, which are arranged individually and not ordered through the shop — are excluded from the right of withdrawal to the extent applicable law permits; this exclusion does not affect statutory rights if such a work arrives damaged, defective or materially different from what was agreed. To start a return, please contact us by email before sending the item back.
Please return the painting packed at least as well as it arrived, using the original protective packing wherever you still have it. You may examine the painting as you would in a gallery in order to establish its nature and characteristics; hanging it on a wall and taking it down again is normal examination. If its value is reduced because it has been handled beyond what is necessary for that, we may reduce the refund accordingly, to the extent applicable law allows. Unless the item is defective, damaged in transit, or incorrectly delivered, the direct cost of return shipping is borne by the customer.

Refunds are made without undue delay and no later than 14 days after we receive the returned item or, if earlier, proof that it has been sent back. 14. Damaged or Defective Items
If your order arrives damaged, defective, or materially different from the description, please contact us without undue delay and provide your order number together with photos of the item and packaging where possible. Nothing in these Terms limits any mandatory consumer rights granted under applicable law.
15. Intellectual Property
All artworks, images, designs, texts, and other content on this website are protected by copyright and intellectual property laws. The purchase of a physical artwork transfers ownership of the physical item only and does not transfer copyright, reproduction rights, or commercial usage rights unless explicitly agreed in writing. Reproduction, distribution, or commercial use without prior written permission is prohibited.

The contents of this website are created with care. However, we do not guarantee completeness, accuracy, or timeliness of the information provided, except where liability cannot be excluded under applicable law.

18. Governing Law
These Terms and any contract concluded through this website are governed by the laws of Ukraine. If you are a consumer habitually resident in the European Union, the United Kingdom, or another country whose law grants you mandatory consumer protections, this choice of law does not deprive you of the protection of those mandatory provisions, which continue to apply alongside Ukrainian law.
19. Jurisdiction
Disputes may be brought before the competent courts of Ukraine. If you are a consumer resident in the European Union or the United Kingdom, you may also bring proceedings before the courts of your own country of residence, and nothing in these Terms restricts that right.

Personal data is processed in accordance with applicable data protection laws and our Privacy Policy. Please read our Privacy Policy to understand how we collect, use, and protect your information.
21. Changes to These Terms
We reserve the right to update or modify these Terms and Conditions at any time. The version published on this website at the time of your order shall apply to that order.
